To sue for 75 G's over a word heard everyday in the schoolyard seems insane though. This moron wants his 5 minutes of media fame.

Sue happy people make me crazy. However as a parent I can see some validity in their arguement. Walmart should have an advisory sticker on any material that some people may feel is inappropriate for young ears. I am actually suprised that WU did not make sure there was one considering how vigilant Walmart has been in the past over these matters.
We are young parents and our children have heard alot of music that is full of bad words but we have also explained to our children that those words are not OK to just say at random or at all. My husbands entire musical library contains parental advisory stickers .
Some people are highly offended by the word "fuck". Those parents who think they can keep their kids from hearing bad words have obviously never been teen-agers or kindergartners for that matter. .
At any rate I can see both sides of the issue but it does appear as someone has already said that these so-called Parental Advisory censorships are inconsistent.

It's very deceiving, imo.
hmm, and notice how some of the other clips are fucked (oops!) up:

Missing = Breathe No More
Breathe No More = My Immortal
My Immortal = Bring Me To Life
Bring Me to Life = Tourniquet
Tourniquet = Imaginary
Imaginary = Whisper
Whisper = Missing

So wal-mart talk bullshit anyway.

I heard about this the other day, and I can easily say it is one of the stupidest things I've heard this month (which is pretty bad, considering the french story about a villain spray painting everything white so his arch-nemesis, Camelion, wouldn't be able to camoflouge anymore )...But seriously, look at the age group it's directed at! Teens and up - not 6 year olds Besides, if f*** is in one song, and they're getting in trouble over it, shouldn't Fallen have a label for "Dark Imagery and Mature Themes"?!!? Not to give them any ideas of course WTF is with these people?!? It's retarded.

butterflygurl will become famous soon enough
OMG they used the F-word!!! Seriously, people. One word will not scar your child for life, besides the girl probably knew worse words than fuck. If you go to practically any school you will hear the word, and I think they're just trying to get rich over this. Why else would they sue over something so dumb?

Let's assume that the parents looked up the lyrics of the song. I'm assuming this because the article that Nat posted said that they listened to the sampling online and it appeared to be clean. That shows that they knew that the song had the word "fuck" in it. Now, I've heard Ev's version of Thoughtless many, many times. Amy doesn't annunciate (is that the right word?) her words when she performs live (like most singers) ESPECIALLY during Thoughtless. Just listen to the part in Thoughtless where it goes "All my friends are gone, they died. They all screamed, and cried." Listen to it. It doesn't sound like Amy's saying those words AT ALL. The first time Ev performed Thoughtless, I was there. I didn't know that it was a Korn song. I had never heard it before in my life. I had no clue that she said "fuck" when she performed it until I looked up the lyrics the day after I got home from the concert. To me, the clip on walmart.com just sounds like she isn't saying the words clearly. Not until upside pointed it out did I notice that it skipped at random places throughout the clip. Now put yourself in the parents' position. They've never heard Thoughtless (I'm assuming). They weren't listening to the rest of the clip to see if it was skipping. They were listening for the word "fuck". I think it's very, very deceiving.

I agree, it should have had a warning sticker on it, however, it is NOT wal-mart's job to do it. Yes - Wal-Mart is the one who wants it censored, because it is a family store. But what is the difference if they would've bought it there, or at best buy? It's still uncensored, and neither had a warning sticker. It's BMG's [Sony's?]responsibility to put the parental advisory.

Who decides what gets labeled?

The decision to label a particular sound recording is made by each record company in conjunction with the artist. The industry as a whole and its individual companies take this program seriously.
That would mean it's Wind-up and Ev's fault.
